Terms of Service

These Terms of Service govern your access to and use of Tuji, including the Tuji mobile app, website, APIs, subscriptions, AI features, Atlas features, and related services.
Tuji is provided by Hong Kuok Wai.
By accessing or using the Service, you agree to these Terms. If you do not agree to these Terms, please do not use the Service.

1. Eligibility
You must be at least 13 years old to use the Service. If the law in your location requires you to be older to use online services or to consent to these Terms, you must meet that higher age requirement.
If you use the Service on behalf of another person, organization, or company, you represent that you have authority to accept these Terms on their behalf.
2. The Service
Tuji is a language-learning service that may include:
- Picture-based vocabulary learning.
- Spaced-repetition study and review.
- Favorites, learned words, progress tracking, and learning settings.
- Custom Atlas or picture dictionary features.
- Image upload and AI-assisted recognition.
- Public or shared user-generated Atlas items.
- Push notifications.
- Free and paid subscription features.
- Rewarded ads or other optional monetization features.
We may add, change, suspend, or remove features at any time, subject to applicable law and platform requirements.
3. Accounts
Some features require an account. You may sign up or sign in using supported methods such as email, Apple Sign-In, or Google Sign-In.
You agree to:
- Provide accurate and current account information.
- Keep your login credentials secure.
- Not share your account with others.
- Notify us promptly if you believe your account has been compromised.
You are responsible for activity that occurs under your account, except where caused by our failure to use reasonable security measures.
4. Guest or Local Use
Some features may be available without signing in. Local or guest data may be stored on your device and may not be recoverable if you delete the app, clear local storage, change devices, or lose access to the device.
If you later create or sign in to an account, Tuji may sync eligible local data to your account.
5. Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, abusive, fraudulent, or misleading purposes.
- Upload, publish, or share content that is illegal, hateful, harassing, threatening, pornographic, exploitative, violent, invasive of privacy, or otherwise objectionable.
- Upload private documents, payment cards, government IDs, medical records, passwords, or other sensitive personal information.
- Upload images of people without appropriate permission.
- Violate intellectual property, privacy, publicity, or other rights.
- Reverse engineer, scrape, copy, overload, attack, interfere with, or disrupt the Service.
- Attempt to bypass usage limits, subscription checks, rate limits, security controls, moderation controls, or access restrictions.
- Use bots, automated scripts, or bulk access methods without our written permission.
- Misrepresent your identity or affiliation.
- Use the Service to train competing models, datasets, or services without our written permission.
We may remove content, restrict features, suspend accounts, or terminate access if we believe these Terms have been violated or if needed to protect users, the Service, or third parties.
6. User Content
"User Content" means content you upload, create, submit, correct, publish, share, or otherwise provide through the Service. This may include images, Atlas items, labels, translations, corrections, descriptions, notes, reports, and custom learning content.
You retain ownership of your User Content.
You grant Tuji a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify, display, distribute, and use your User Content as needed to:
- Provide and operate the Service.
- Generate thumbnails, cards, recognition results, study materials, and related features.
- Sync your data across devices.
- Review, moderate, and enforce these Terms.
- Display content that you choose to publish or share.
- Improve safety, reliability, and product quality.
This license lasts as long as needed to provide the Service and comply with these Terms. For public or shared content, the license continues until the content is removed from public availability, except where copies, backups, logs, moderation records, legal records, or previously shared versions must be retained.
You represent that you have all rights necessary to upload and use your User Content with the Service.
7. Public Atlas Content and Moderation
Atlas images and custom items are private by default unless you choose to publish, share, or make them public.
If you publish or share content:
- Other users or the public may be able to view it.
- The content may include images, thumbnails, vocabulary labels, translations, category information, and related learning content.
- Other users may report the content.
- We may review, reject, remove, restrict, or disable access to the content.
You must not publish or share content that:
- Contains private, sensitive, or confidential information.
- Infringes copyright, trademark, privacy, publicity, or other rights.
- Is spam, deceptive, abusive, hateful, sexual, exploitative, violent, or otherwise objectionable.
- Contains images of people without appropriate permission.
- Encourages unsafe, illegal, or harmful behavior.
We are not obligated to monitor all content, but we may do so. We may remove content at our discretion.
8. AI Features
Tuji may provide AI-assisted features, including image recognition, vocabulary suggestions, translations, definitions, enrichment, and related learning content.
You understand and agree that:
- AI results may be inaccurate, incomplete, inappropriate, or misleading.
- AI results are suggestions and should be reviewed before relying on them.
- You are responsible for correcting AI-generated content before publishing or using it in important contexts.
- AI features may depend on third-party providers such as OpenAI, Google Cloud Vision, or Google Translate.
- Uploaded images or processed copies may be sent to third-party providers when you use AI recognition.
- Text labels, translations, vocabulary suggestions, and related content may be sent to third-party providers when you use translation or AI enrichment features.
- AI features may be subject to usage limits, rate limits, subscription limits, or availability limits.
Do not use AI features for legal, medical, financial, safety-critical, emergency, or other high-risk decisions.
9. Subscriptions and Paid Features
Tuji may offer paid features, including Tuji Pro subscriptions.
Subscriptions purchased through the Apple App Store are processed by Apple. Your purchase, billing, renewal, cancellation, refund, and payment method are handled by Apple and are subject to Apple's terms and policies.
Auto-renewable subscriptions renew automatically unless cancelled before the renewal date through your Apple account settings or other Apple-provided subscription management tools.
We may store subscription status, expiration date, and transaction identifiers so that we can provide paid features and process renewals, refunds, or subscription changes.
Subscription features, prices, limits, and availability may change over time. If required by law or platform rules, changes will apply according to the notice, consent, or renewal process provided by Apple or Tuji.
Purchasing a subscription does not guarantee that all features will remain unchanged forever. However, we will not intentionally remove paid access in a way that violates applicable law, platform rules, or consumer protection requirements.
10. Refunds and Cancellations
For subscriptions purchased through the App Store, refund and cancellation requests must be handled through Apple unless Apple or applicable law provides otherwise.
Deleting the app or deleting your Tuji account does not automatically cancel an App Store subscription. You must cancel the subscription through your Apple account settings.
If you delete your Tuji account while you still have an active subscription, you may lose access to account-linked features even though the subscription remains managed by Apple.
11. Rewarded Ads
Tuji may offer rewarded ads or similar optional features. Rewards, limits, availability, and eligibility may change at any time.
We may deny, reverse, or limit rewards if we believe ads were viewed through fraud, automation, abuse, technical manipulation, or violation of these Terms.
Rewarded ads may be provided by third-party advertising providers such as Google AdMob and may be subject to their own terms and policies.
12. Push Notifications
If you enable push notifications, Tuji may send reminders, learning prompts, account notices, or service-related messages.
You can disable notifications through your device settings. Some service-related communications may still be sent through other channels, such as email, where appropriate.
13. Account Deletion and Termination
You may delete your account from within the app where available or by contacting us at nexflow0632@gmail.com.
Deleting your account is generally irreversible and may delete account-linked data such as profile information, learning progress, settings, private Atlas images, and custom content, except where retention is required or permitted for legal, security, fraud prevention, billing, backup, dispute resolution, or moderation purposes.
We may suspend or terminate your access to the Service if:
- You violate these Terms.
- Your use creates risk or harm for Tuji, users, or third parties.
- We are required to do so by law or platform rules.
- We discontinue the Service or a material part of it.
Upon termination, your right to use the Service ends immediately.
14. Privacy
Our collection and use of personal information is described in our Privacy Policy.
By using the Service, you acknowledge that we may process information as described in the Privacy Policy.
15. Intellectual Property
Tuji and its software, design, branding, logos, interfaces, content, databases, and other materials are owned by Tuji or its licensors and are protected by intellectual property and other laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial learning purposes.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works based on the Service except as permitted by law or with our written permission.
16. Third-Party Services
The Service may integrate with or rely on third-party services, including Apple, Google, Supabase, Vercel, Firebase, OpenAI, and other providers.
We are not responsible for third-party services, content, policies, outages, actions, or terms. Your use of third-party services may be subject to their own terms and privacy policies.
17. App Store Terms
If you download Tuji from the Apple App Store, the following additional terms apply.
These Terms are between you and Tuji, not Apple. Apple is not responsible for the Service or its content.
The license granted to you for the Service is limited to a non-transferable license to use the Service on Apple-branded products that you own or control, and as permitted by Apple's applicable usage rules.
Apple has no obligation to provide maintenance or support services for the Service, except as required by applicable law.
If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, according to Apple's applicable policies. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Service.
Apple is not responsible for addressing claims by you or any third party relating to the Service or your possession or use of the Service, including product liability claims, legal or regulatory claims, consumer protection claims, or intellectual property infringement claims.
You represent and warrant that you are not located in a country or region subject to a U.S. government embargo or designated by the U.S. government as a terrorist-supporting country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of this section. Upon your acceptance of these Terms, Apple has the right to enforce this section against you as a third-party beneficiary.
18. Service Availability and Changes
We try to keep the Service available and reliable, but we do not guarantee that it will always be available, uninterrupted, secure, or error-free.
We may:
- Modify, suspend, or discontinue any part of the Service.
- Add or remove features.
- Change usage limits.
- Restrict access for maintenance, security, legal, or operational reasons.
- Update the app or require you to use a supported version.
We are not liable for loss caused by service interruptions, changes, or discontinuation, except where prohibited by law.
19. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability.
Tuji is a learning tool. We do not guarantee that the Service will improve language ability, produce accurate translations, identify images correctly, preserve all data, or meet your expectations.
20. Limitation of Liability
To the fullest extent permitted by law, Tuji and its affiliates, officers, employees, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities.
To the fullest extent permitted by law, our total liability for any claim related to the Service or these Terms will not exceed the greater of:
- The amount you paid to Tuji for the Service in the 12 months before the claim arose.
- USD 100.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
21. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Tuji and its affiliates, officers, employees, contractors, service providers, and licensors from claims, damages, losses, liabilities, costs, and expenses arising from:
- Your use of the Service.
- Your User Content.
- Your violation of these Terms.
- Your violation of law or third-party rights.
22. Governing Law and Disputes
These Terms are governed by the laws of the Macao Special Administrative Region, without regard to conflict-of-law rules.
Any dispute arising from or relating to these Terms or the Service will be resolved in the competent courts of the Macao Special Administrative Region, unless applicable law requires another forum.
Before filing a claim, you agree to contact us at nexflow0632@gmail.com and try to resolve the dispute informally.
Nothing in these Terms limits any rights you may have under applicable consumer protection laws in your country or region.
23. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a new "Last updated" date.
If changes are material, we may provide additional notice, such as in-app notice, website notice, or email where appropriate.
If required by law, we will request your consent before applying material changes that affect your rights or obligations. Otherwise, your continued use of the Service after the updated Terms become effective means you acknowledge the updated Terms.
